DATA PROTECTION INFORMATION (PRIVACY INFORMATION)
WeBorn services and contractual services and online presence
In this data protection information, we inform you about the data processing of personal data carried out by WeBorn GmbH (hereinafter "WeBorn", "we" or "us") in the context of (i) our regular range of services, with the exception of (ii) our online presence, including our website, for which a separate data protection information is provided below. For ease of use, this information uses predominantly masculine terms. However, these are to be understood as gender-neutral and therefore apply to all other affiliations. Conversely, this also applies to other gender-related definitions.
Without the processing of your personal data, it is not possible for us to do business and offer you our services or fulfill the contracts concluded. In any case, it is particularly important to us to inform you in a transparent manner about the type, scope, duration and purpose of the processing of your personal data (hereinafter referred to as "data") within our entire range of services:
A) Data protection when using WeBorn services
(1) Responsible for data processing, contact options
The data controller responsible for processing your data is WeBorn GmbH, FN 615743 f, with its registered office in Vienna and its current business address at Invalidenstraße 11 Top I/II, 1030 Vienna.

(2) Purposes of data processing and legal basis
a) Purposes
Without the processing of your data, we are unfortunately unable to offer our services in full. However, we are of course obliged to process only those data that are necessary for the purpose of providing our services. These purposes include, in particular, data processing for the purpose of
· the provision of our WeBorn services, including the provision of our website for your use
· customer information recording (as part of bookings online and in the studio)
· the contractual processing of registrations and bookings via our internal systems and partner systems
· the processing of payment transactions
· one-off or regular customer information, in particular via newsletters
· marketing measures, including information and communication with customers and interested parties
· for video surveillance for security reasons , but not in the highly personal area
· to contact us
· any competitions and special promotions
· the organization and promotion of (online) events
· the lawful transfer to pre-defined processors that we use to process our services (in particular Eversports as a booking platform)
Please note that it is not possible for us to list all conceivable purposes, as these are constantly changing and new ones may be added. Please rest assured that we will always endeavor to inform you in advance of any data processing for a specific purpose.
b) Legal basis
Your data is processed lawfully in accordance with applicable data protection laws, in particular the General Data Protection Regulation (GDPR), the Data Protection Act (DSG) and the Telecommunications Act (TKG), and we base this on the following legal bases:
- your consent (Art. 6 (1) lit. a) GDPR)
- the necessity of fulfilling (pre-)contractual obligations (Art. 6 (1) lit. b) GDPR)
- fulfilling legal obligations to which we are subject (Art. 6 (1) lit c) GDPR)
- · on our legitimate interest (Art. 6 (1) lit. f) GDPR); in particular, the special interest in preventing unlawful or criminal behavior (e.g. identity theft), the purposes of direct marketing and the transfer of data to affiliated companies), as well as security in the provision of our services, especially from a health perspective.
(3) Data collection and data categories
WeBorn collects and stores any information
- · which the user directly provides to us, either by contacting us (e.g. via the contact form) or in person at our studio/s
- which the user provided to us via the Eversports booking platform used and which are transmitted to us for contract processing;
- as part of permitted video surveillance in our WeBorn studios;
- which we lawfully receive from third parties (e.g. in the context of direct marketing or in the context of an address publisher (§151 Industrial Code);
The data collected and processed from you are in particular
· name
· date of birth
· address
· telephone number and/or email address
· home address
· bank details (for payment processing)
· membership number
· IP address and associated browser data
· Access and user data in connection with visits to our website (e.g. date and time, data volumes, operating system, etc.)
· Image data (in the context of video surveillance)
If you give your consent online, this will be logged accordingly using suitable technical systems. We only collect special categories of data (e.g. health status or information on previous illnesses) with your consent and therefore on a voluntary basis.
(4) Duration of the processing of your data
The processing duration of your data, in particular the storage, only takes place as long as this is absolutely necessary or legally required, or as long as another legal basis for the processing of your data exists, e.g. consent in the case of a newsletter (which is valid until revoked).
In particular, we are subject to statutory retention obligations, which is why your personal contract data will be stored for a maximum of seven (7) years after the end of the calendar year in which the service relationship with you existed if you use our services and thus conclude a contract. Other retention periods apply to the processing of your data in other cases. For example, we generally delete your data that we have received in the course of contacting you after six (6) months. We store data for ten (10) years in connection with electronically provided services, telecommunications services that are provided to non-entrepreneurs in EU member states and are used for the so-called mini-one-stop-shop procedure. In addition, the storage period is also assessed according to the statutory limitation periods, which according to §§ 1451 ff. Austrian Civil Code can be three (3), but also up to thirty (30) years.
(5) Data disclosure, data transfer to third countries and profiling
Within WeBorn, only those departments and persons who need your data to fulfill the relevant purpose and legal obligations will receive it. Processors and other service providers employed by us may also receive data for these purposes. These are companies in the categories of IT services, banks, telecommunications, debt collection and printing services. In addition, joint controllers receive your data for the necessary purposes.
In any case, data will only be passed on if this is permitted. Under these conditions, recipients of your data may be public bodies and authorities (e.g. tax authorities). Your data will not be transferred to any third country. Should data be transferred to such a country, you will be informed in advance. Furthermore, such a data transfer will not take place without your consent or another legal basis that justifies such a data transfer. Such a case is particularly possible when using our online offer.
As the controller, we do not make automated decisions in individual cases and no profiling takes place.
(6) Your rights; supervisory authority
As a data subject, you have the following rights:

B) Data protection when using our online services
Our online offering is very diverse and includes various media, such as our website, but also appearances on social media such as Facebook or Instagram. The following provisions concern data protection information relating to the processing of data in the context of our online offering. Unless otherwise stated below, the data protection information mentioned under point (A) also applies to our online offer.
(1) Website and newsletter
WeBorn GmbH is the operator and responsible for the website https://weborn.com. The website gives you the opportunity to find out more about us and our range of services. You also have the option of subscribing to our newsletter. If you register for our newsletter, you consent to us sending you information such as current products, innovations, promotions, advertising, surveys or other information to the email address you have provided until you withdraw your consent. You can revoke this consent at any time by using the contact options provided by WeBorn GmbH. You can also unsubscribe via the "Unsubsrcibe-Button" .
The following data may be processed when you access our website:
- · date and time of access to the website or online offer
- · the operating system you are using or the browser you are using and which browser version is being used;
- · the Internet service provider you use
- · your IP address
This data is temporarily stored in server log files. This data is not stored together with your other data
(2) Cookies
We use cookies as part of our online offer. Cookies are small text files that are stored in your Internet browser or on your computer system. Cookies are downloaded when you access a website. Cookies contain one or more characteristic character string(s) that enable the browser to be uniquely identified when the website is called up again. In addition, cookies facilitate the full browsing experience.
Temporary cookies, or "session cookies", are cookies that are deleted after a user leaves the online offer and closes the browser. A login status, for example, can be stored in such a cookie. "Permanent" or "persistent" cookies are cookies that remain stored even after the browser has been closed. In this way, for example, a login status can be saved if a user visits the online offer after several days. User interests that are used for reach measurement or marketing purposes can also be stored in such a cookie. (3) Google services
Google Analytics
We use the services of Google Analytics. This is a web analysis service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). Google Analytics uses cookies to enable us to analyze the use of our online offering. This provides us with feedback on what we can do to improve our services.
The information generated by the cookies about your use of the online offer is usually transmitted to a Google server in the USA and stored there. However, your IP address will be shortened by Google beforehand within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. The cookies stored by Google Analytics are deleted after 26 months at the latest.
By using the Google Analytics service, we also want to ensure that our ads placed with Google or its partners correspond to the potential interest of the people to whom the ads are displayed. With the help of the so-called "remarketing" or "Google Analytics audiences" functions, our ads are only displayed to people who have also shown an interest in our online offering or who have certain characteristics specified by us (e.g. interests in certain topics or products determined on the basis of the website visited).
The legal basis for the processing of personal data using cookies in connection with the use of Google Analytics for analysis purposes is permitted if you have given your consent in accordance with Art. 6 para. 1 lit. a GDPR. We obtain this consent either by confirming it in a cookie banner or in some other way in advance.
